Work permits
How Spain jobs for foreigners work under the initial residence and employment authorisation, the national employment situation test and the employer file.
EU Job Hub Editorial Team · Updated 1 October 2026
Spain jobs for foreigners from outside the EU need a work and residence authorisation. The employer asks for it, not the worker. The authorisation is for employed work of more than ninety days and less than five years.
This guide follows the Spanish Ministry of Inclusion, Social Security and Migration and the Ministry of Labour. It explains the main test and the file. Rules have details, so confirm them with the immigration office.
| Authorisation | Initial temporary residence and employment authorisation |
| Who applies | The employer or employer representative |
| Duration covered | More than 90 days and less than five years |
| Minimum age | Worker over 16 |
| Main test | National employment situation must allow the hire |
| Official sources | inclusion.gob.es and mites.gob.es |
The initial authorisation combines residence and paid employment. It is requested for hiring a foreign worker over 16. The period is more than ninety days and less than five years.
It can also allow self-employment during its validity, if the main activity is employed work. Check the exact terms in your decision.
The employer or employer’s representative files the application. Legal representation must be proven if another person files. The worker does not file the initial request.
The employer provides its tax number or identity number. It also provides the official employment contract model. Documents from other countries must be translated into Spanish by a sworn translator.
The key test is the national employment situation. The authorities must find that the situation allows the hire. In simple terms, the job should not be fillable from the local labour market.
Employers often show this through the public employment service. They publish the offer and record the result. The office checks whether the post could be filled.
The Ministry of Labour lists cases where the national employment situation is not considered. Examples include children or grandchildren of Spanish citizens by origin, and artists of recognised prestige.
Hard-to-fill occupations are also important. The rules note that an occupation classed as hard to fill allows the employer to process the authorisation. Ask the employer whether your job is on that catalogue.
Fees for residence and work are due when the application is filed. They must be paid within ten working days. The employer normally handles this stage.
Ask your employer for the expected timeline. Do not leave your current job until the authorisation and visa are confirmed.
If the work authorisation lasts six months or more, you may need a visa to enter and stay in Spain. The visa lets you begin the residence procedure. After arrival, you request your foreigner identity card.
Follow the instructions in your authorisation decision. Deadlines after arrival are strict.
Initial authorisations can be limited by region and occupation. Renewal can be for a longer period and open more options. The rules vary with the type of authorisation.
Read the conditions in your card. Ask the immigration office before you change employer or occupation.
Use EURES, public employment portals and company career pages. Sectors with hard-to-fill roles are a good place to start. Write a CV that shows clear experience and dates.
Tell employers early that you need sponsorship. Ask whether they have hired non-EU workers before.
Do not start work before you hold the authorisation. Do not pay intermediaries who promise a visa. Do not send originals without copies.
Can I apply for the work authorisation myself? No. The employer or its representative files the initial application.
What is the national employment situation? It is the test of whether the labour market allows hiring a foreign worker for the job.
How long can the authorisation last? The initial authorisation covers more than ninety days and less than five years.
Do documents need translation? Yes. Foreign documents must be translated by a sworn translator.
Find an employer who is ready to file. Then confirm whether your occupation is hard to fill. Check every requirement with the immigration office before you travel.
Use official platforms and national authorities to verify current rules before applying or travelling.
